Information Diet: Joel McHale

Information Diet: Joel McHale August 26, 2011 Photo by Jason LaVeris/Getty Images Joel McHale What's the first information you consume in the morning? I usually check my BlackBerry, my messages, and Twitterthat's when I'm lying in bedand then I check the front page of CNN.com. I usually have to be very quiet, because I'm up before the family, especially if I'm doing "Community."What do you read or watch or listen to at the breakfast table? Nothing, hopefully. I just stare at my children if they're there. We try to have breakfast together if we can, and if that's the case, we try to have zero media going on. What occupies your mind in the car, on the subway, train, or bus? I don't spend a lot of time on the subway here in L.A. Until they lay about a thousand miles of more tunnels, it's going to be tough. In my car, I'm on my phone a lotbut don't worry, it's all Bluetooth, hands-freeor I listen to satellite radio, the 1st Wave or Lithium station. Or, I'll just listen to music, anything from the new Fleet Foxes album to the soundtrack of "Submarine," a British movie that I love. Are you a TV junkie, or on an airtime-restricted diet? I'm on a restricted diet only because I don't have time to watch it. Between Community and "The Soup," I put in 80 to 90 hours of work every week.If you're a couch potato, what do you watch, and how: TV, laptop, or tablet? There's no way I could keep up with everything we air on "The Soup"it would be impossible. I still record "Hoarders and [Confessions:] Animal Hoarding" and things like that, but I don't always get to see them. If I'm on a plane or for whatever reason I can steal an hour, I'll watch "Breaking Bad" or "Louie." I'm actually watching "Falling Skies" right now. Before bed, do you: bite into a novel; graze on Twitter; or fast until morning? Before I go to bed, I usually watch SportsCenter. Maybe if I'm lucky I catch a late-night talk show, or I'll play a game on the iPadAngry Birds, Death Rally, or NBA Jam. If I get a wild hair up my ass, then I'll turn on my PlayStation 3 and play some Bulletstorm.Which is more nutritious: print or the Web? I'm going to go with the Web, just because it's more easily digestible, and you can share it faster. Give us the skinny on your favorite app. I love Shazam a ton. I can't believe how well it works. And my 6-year-old and I play Plants vs. Zombies. What's your biggest digital indulgence? Jeez . . . I have to say my abacus. With such a bloated media universe, how do you cut out the fat? You just close your eyes and put your hands over your ears and go, "La la la la la." Is Ric Flair Becoming the Real-Life Randy 'The Ram' Robinson?

Many pro wrestlers have suffered trials and tribulations similar to those endured by the troubled former ring champ in decline played by Mickey Rourke in Darren Aronofsky’s 2008 Oscar nominee The Wrestler. But as a particularly sad investigative report by Grantland suggests, wrestling veteran Ric Flair (born Richard Fliehr), whose personal and financial troubles have sent him into a steep decades-long decline, may be the closest the WWE/TNA world currently has to a real life Randy “The Ram” Robinson. Domestic woes, multiple divorces, expensive habits, financial mismanagement, violent outbursts, terrible business decisions, shady business partners… it’s all in Grantland’s investigation into how Flair managed to whittle his fortune away, fall deep into debt, and go through multiple divorces in the past few decades while trying desperately to stay afloat, working all the while in the most physically brutal profession in entertainment. Excerpted from Grantland: Today the story is about a man known in the court system as Richard Morgan Fliehr, 62, born in 1949 and adopted by parents who raised him in Minnesota. That’s what he was called this past April, when a judge ejected Fliehr from his Charlotte home because he couldn’t pay his rent. That’s what he was called in May, when he faced an arrest order for an unpaid $35,000 loan. That’s what he’s called on the paychecks from Total Nonstop Action, a second-tier outfit where he’s still compelled to perform despite suffering from alcoholic cardiomyopathy, and where almost everything he earns goes toward old debts: lawyers, ex-wives, the IRS, former business partners, and anyone who made the mistake of lending him money. The entire chronological account of Flair’s past few decades of life mismanagement can be found here. Ironically, Flair shared the ring with actor Rourke to promote The Wrestler at a WWE event in 2009, teaming up with him in a face off against Chris Jericho. Here’s to hoping the Nature Boy can sort things out before things get as dire as they did for The Ram. The Wrestler in Real Life [Grantland]

Kim Kardashian and Kris Humphries Sign Pre-nup; Lawyer Breaks Down What It Means

Jason Merritt/Getty Images E! reality TV star Kim Kardashian and new husband Kris Humphries have signed a pre-nuptual agreement. A knowledgeable source tells The Hollywood Reporter that the negotiations, which had been widely reported, are now done. But what does that mean? Most people probably assume it means that Kardashian's estimated $35 million net worth will now be protected against the double dribbling of an NBA player who is only worth somewhere between $8-16 million. Perhaps, but as we learned from Laura Zwicker, a family wealth planner at LA's Greenberg Glusker law firm, drawing up a pre-nup in a post-reality TV universe is a tad more complicated than just that. For starters, Zwicker tells us not to assume that Humphries, an NBA free agent, is necessarily the loser here. The attorney points out that Kardashian has a knack for getting into all sorts of legal trouble from her business ventures, which means she could be one adverse judgment away from seeing her fortune seriously diminished. "He could actually benefit if it clearly delineated that debts and liabilities are actually hers," says Zwicker. On the other hand, perhaps it's not Kim who needs the protection, but other family members who are entangled in business ventures with the 30-year-old personality. Under California law, increases in value of a joint venture during a marriage are considered a couple's community property, unless otherwise waived in the pre-nup. In other words, the deal may go well beyond protecting the $35 million or so in assets, it might reach further to safeguard the entire Kardashian fortune. STORY: Kim Kardashian on Wedding: 'It Was Like Heaven' We had more questions for Zwicker. Here's our Q&A with the celebrity pre-nup expert: THR, Esq.:In many legal practice areas, we see trendy legal theories. Does the same go for pre-nups? In twenty years, might we look back at Kim Kardashian's pre-nup and go, 'Damn, that had to have been drafted in 2011'? Zwicker: Yes. Like everywhere, there are things that are hot now that people won't be doing in 25 years. For example, we are now seeing a lot of structured support payments in pre-nups that I'm not sure are going to be enforceable when marriage ends. Historically, clients didn't touch spousal support in these contracts, but ten years ago, a ruling in a court case suggested that parties could waive or structure their structural support. After the case, wealthy clients started [asking their significant other to] waive support, but upon a recognition that courts were less likely to enforce that, they went the other way, and now try to set forth an agreement whereby the parties get certain amounts depending on the length of marriage. Courts have a very complex calculator for determining spousal support, so I'm wondering if that's going to survive. STORY: Kim Kardashian Wedding: How the Media Covered THR, Esq.: We have to be honest: Ninety-seven percent of what we know about pre-nups comes from George Clooney in Intolerable Cruelty. Is there really such thing as an air-tight pre-nup and can it be truly be cancelled in a moment of dramatic romanticism when one of the parties just literally tears it apart? Zwicker:Family code sets out very clear rules to make an enforceable pre-nup. If you followed the rules, you should have an air-tight pre-nup. But I have seen clients -- as result of very aggressive lawyering on the other side -- provide more than what was originally set forth. An air-tight pre-nup works theoretically, but the problem is that it gets so painfully expensive it triggers a settlement. Oh, and these pre-nups can't be cancelled without both parties being represented by counsel. STORY: Kim Kardashian's Official Wedding Photos Hit Web; Were They Worth $1.5 Million? THR, Esq.: We haven't checked Kris Humphries' free-throw percentage lately, but we assume he can afford a pretty good lawyer. If things ever go south for the couple, could he ever push back on Kardashian and claim the contract was unconscionable? Zwicker:In their situation, it's less likely that a court would find it wasunconscionable. They are similarly situated. She might have 10 times as much assets as he has, but he is not poverty stricken. THR, Esq.: This mightbe the landmark pre-nup of the reality TV era. As such, what's the chances the pre-nup can guide post-nup activity, such as who gets to star on which E! show and whether there are any restrictions on the release of a sex tape or that type of thing? STORY: Kim Kardashian Wedding Cheat Sheet: Everything You Need to Know Zwicker:I actually hadn't thought about that. Pre-nups govern the parties' property. To the extent that name and likeness are property, I would guess that a pre-nup could govern how they are going to be governed and exploited THR, Esq.:OK, from 1 to 10, what would be the entertainment factor of a reality TV show that focused on family lawyers doing things like drawing up pre-nups for celebrity clients like Kim Kardashian? Zwicker:A 10. My guess is you would get a very good audience. The actual drawing up would be extremely boring, but you could make a reality tv show where the two lawyers are battling it out for support, name and likeness, and rights. Atom Egoyan-Helmed West Memphis 3 Feature Film on Tap for Spring

It seemed inevitable that Hollywood would turn its gaze on the incredibly dramatic tale of Damien Echols, Jessie Misskelley, and Jason Baldwinthe, the men known as the West Memphis 3 who were freed today after spending 18 years serving time for the 1993 murders of three young boys. But this isn’t an opportunistic stroke of timing; the film, which will be directed by Atom Egoyan, has been in development since 2006. More after the jump. According to Deadline, the film, entitled Devil’s Knot and based on Mara Leveritt’s 2003 book Devil’s Knot: The True Story of the West Memphis Three, will begin lensing in the spring: Devil’s Knot is an under $20 million feature that has The Sweet Hereafter and Chloe director Atom Egoyan aboard to direct a script that was originally written by Scott Derrickson and Paul Boardman, the team behind The Exorcism of Emily Rose. Egoyan has spent the last six weeks working with Boardman on a rewrite. Devil’s Knot, an indie production, is said to have the life rights to the case’s real-life supporting players including private investigator Ron Lax but life rights to the central trio have not been secured, perhaps suggesting that the story will focus not on the men themselves but the efforts of those around them to fight the convictions. Meanwhile, filmmakers Joe Berlinger and Bruce Sinofsky, who followed the West Memphis 3 case in their 1996 documentary Paradise Lost: The Child Murders at Robin Hood Hills, will screen their second follow-up film, Paradise Lost 3: Purgatory, next month at the Toronto Film Festival. 'Madagascar' Spin-Off to Be Helmed by 'Bee Movie' Co-Director (Exclusive)

DreamWorks Animation Simon Smith, who co-directed DreamWorks Animations' Bee Movie, had been tapped to direct the animation house's untitled Madagascar spin-off starring the penguins. Also coming on board is Lara Breay (Megamind), who will produce. DWA put the movie project into fast-track development in March, hiring Alan J. Schoolcraft and Brent Simons, the writers behind DWA's Will Ferrell-voiced Megamind, to pen the script focusing on the paramilitary parables of plucky penguins Skipper, Kowalski, Private and Rico. The quartet are the secondary but scene-stealing characters of the Madagascar movies. The project is still a ways a way from casting anyone. Smith is a DWA animator who has slowly but surely risen through the ranks. He was head of layout for the company's Antz and Shrek, and a layout consultant on Shrek 2 before directing the Shrek 4-D animated attraction which is part of the Universal Studios theme park. He also directed two video shorts that were DVD extras on DWA releases: the Shrek-themed short Far Far Away Idol and Megamind: The Button of Doom. The Jerry Seinfeld-centric Bee Movie, released in 2007, was co-directed with Steve Hickner. DreamWorks Animation Madagascar
